Arette Terms of Service
These Terms of Service govern your relationship with Arette Technologies Ltd. (incorporated and registered in England and Wales, United Kingdom) and its operating subsidiary Arette Technologies Nigeria Limited (incorporated with the Corporate Affairs Commission, Federal Republic of Nigeria) (collectively "Arette", "we", "us", or "our") when accessing our platform, showcasing creative portfolios, providing or purchasing freelance services, and participating in our educational programs.
1. Acceptance of Terms & Eligibility
These Terms of Service ("Terms") govern your access to and use of Arette (https://arette.xyz) and related applications operated by Arette Technologies Ltd. (incorporated in England and Wales, United Kingdom) and its operating subsidiary Arette Technologies Nigeria Limited (registered with the Corporate Affairs Commission, Federal Republic of Nigeria) ("Arette", "we", "us", or "our"). For users in Nigeria, local payment gateway integrations and NGN milestone disbursements are managed in coordination with Arette Technologies Nigeria Limited, with platform governance and global milestone escrow overseen by Arette Technologies Ltd.
By creating an account, publishing content, offering freelance services, applying for jobs, or making purchases on Arette, you represent that you are at least 18 years old (or the legal age of majority in your jurisdiction) and have legal authority to enter into these Terms.
2. Account Authenticity & Security
You agree to provide true, accurate, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Users are limited to one active personal account. Creating multiple or duplicate accounts to manipulate rankings, circumvent restrictions, or harvest rewards is strictly prohibited. Selling, purchasing, or renting Arette accounts is strictly forbidden.
3. Intellectual Property, 100% Creator Ownership & DMCA Policy
You retain 100% full copyright and intellectual property ownership over all original artworks, illustrations, 3D models, articles, video content, design systems, and code you upload to Arette. Arette claims zero proprietary ownership over user-submitted creative assets.
If you believe that your copyrighted work has been infringed on Arette, please submit a formal notice to our Designated Copyright Agent at dmca@arette.xyz.
4. Freelance Marketplace & Milestone Escrow Rules
When a client orders a service or signs a milestone contract on Arette, funds are securely held in escrow until the creator submits the deliverable and the client approves the work. In the event of a disagreement, parties may request formal dispute resolution.
Users who meet or establish contact on Arette agree to conduct all contract milestones and transactions through Arette. Solicitations to divert payments outside Arette are strictly prohibited and result in immediate account termination.
5. Utility Token Economy (ARC & Credits)
ARC tokens are platform utility tokens used for creator tipping with 0% platform commission, feature access, and community interactions. Platform Credits are non-transferable credits used for service purchases.
6. Job Board & Recruiter ATS Rules
Enterprise recruiters and verified companies posting job openings must represent legitimate employment opportunities. Recruiters agree to handle applicant data (including PDF resumes and candidate screening answers) in strict confidentiality and in compliance with GDPR and applicable labor laws.
7. Academy Classrooms & Maya AI
Academy course materials, curricula, and video lessons are licensed for personal educational use. Automated scraping or unapproved redistribution of course materials is prohibited. Maya AI provides educational guidance and coding critiques; users remain responsible for validating AI suggestions before deploying to production.
8. Meritocracy Rankings & Fair Play
Arette features a meritocratic ranking system based on community feedback, verified expert jury evaluations, and genuine platform engagement. Any automated voting, manipulation rings, or botting activities are strictly prohibited and result in permanent score disqualification.
9. Prohibited Conduct & Community Safety
Users may not upload malicious code, engage in hate speech, harassment, impersonation, or copyright infringement. Arette reserves the right to suspend or terminate accounts that violate community safety standards.
10. Paid Tier Subscriptions & Billing
Subscriptions (Pro, Agency, Recruiter) renew automatically at the end of each billing cycle unless cancelled prior to renewal in Account Settings. All fees are clearly displayed prior to confirmation.
11. Disclaimers & Limitation of Liability
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARETTE DISCLAIMS ALL WARRANTIES AND SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR SERVICES.
12. Dispute Resolution & Governing Law
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales, United Kingdom. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim, provided that local statutory consumer protections under the Nigerian Federal Competition and Consumer Protection Act (FCCPA 2018) apply to Nigerian domestic transactions where mandatory, and either party may seek emergency injunctive or provisional relief in any court of competent jurisdiction.
